What a Nevada trustee’s deed does
A trustee’s deed is the deed a trustee signs to move real estate out of a living trust — most often to the beneficiaries after the person who made the trust has died, or to a buyer when the trust sells. In Nevada it is a grant, bargain and sale deed or quitclaim deed signed in the trustee’s capacity, recorded with a Declaration of Value.
If the original trustee has died, the successor trustee usually records an Affidavit of Successor Trustee first. A distribution to a beneficiary made without payment, with a certificate of trust presented, is generally exempt from Nevada’s Real Property Transfer Tax; a sale to a buyer is taxed on the price, at $2.55 per $500 in Clark County as of 2026.
TruPoint prepares the trustee’s deed for $400, the Affidavit of Successor Trustee for $250 and the certificate of trust for $200, and submits the deed to the county the same day it is signed, in any of Nevada’s 17 recording jurisdictions.
Six situations that call for a trustee’s deed
Which document fits your situation is your decision, guided by the trust itself. These are the situations the trustee’s deed is built for.
A parent died and the trust names the children
The trust says the house goes to you and your siblings. The successor trustee deeds it to the beneficiaries the trust names.
Trustee’s deed, $400The trust is selling the house
The beneficiaries want the sale proceeds, not the property. The trustee signs the deed to the buyer.
Deed for a sale, $400The successor trustee is not on record yet
The original trustee died and nothing has been recorded since. The affidavit has to record before the trustee can convey.
Affidavit $250 + deed $400You are the trustee and live out of state
You are settling a parent’s Nevada trust from another state and cannot travel to Las Vegas or Reno.
Remote notary, $25 per signatureYou want your house back out of your own trust
You made the trust and want the property titled to you personally again, as trustee deeding to yourself.
Trustee’s deed, $400A court appointed you administrator
There is no trust, and a Nevada court has appointed you to administer the estate and authorized the transfer.
Administrator’s deed, $400The paperwork chain after a trustee dies
A trustee’s deed only works if the record shows the person signing it has authority. That is why the documents usually record in this order.
1. Death certificate
A certified copy for the trustee who died. You order it from the county or state vital records office.
2. Affidavit of Successor Trustee
Records the successor trustee’s authority so the county record matches who can sign. We prepare it for $250.
3. Certificate of trust
Summarizes the trust without exposing its terms; presented to support the transfer tax exemption. We prepare it for $200.
4. Trustee’s deed and Declaration of Value
The deed from the trustee to the beneficiaries or buyer, with the Declaration of Value stating the value and any exemption claimed. $400.
When Nevada transfer tax applies to a trustee’s deed
Nevada’s Real Property Transfer Tax is $1.95 per $500 of value statewide, $2.05 in Washoe County and $2.55 in Clark County. Whether it applies depends on the kind of transfer, and the county recorder decides any exemption at recording from the supporting documents presented with the deed.
| Type of transfer | Transfer tax | Supporting documents the county asks for |
|---|---|---|
| Trust to beneficiary, no payment, estate-planning trust | Generally exempt | Certificate of trust or the trust agreement |
| Trust back to the person who made it, no payment | Generally exempt | Certificate of trust or the trust agreement |
| Trustee sells to a buyer | Taxed on the price | Closing statement or purchase agreement |
| Beneficiary pays others for their shares | Tax may apply to the amount paid | Documents showing what was paid |
| Transfer involving a trust that is not an estate-planning trust | May be taxed; the county decides | Trust documents; ask the county audit team |
General information from Nevada’s transfer tax statute and the Clark County Recorder’s published exemption guidance, October 2026. It is not advice about your transfer; the county recorder makes the final determination.

From intake to a recorded trustee’s deed
Everything runs remotely, so a successor trustee in another state never has to travel to Nevada.
Complete intake
Tell us about the trust, the property and the beneficiaries in the property transfer questionnaire, or do it with us free by phone or video, Monday to Friday, 10 a.m. to 6 p.m., in English or Vietnamese.
Disclosure, contract, one payment link
We review your answers and email if anything needs clarifying, then send the written disclosure, the contract and one payment link with no markup on county fees. Drafting starts once they are signed and paid.
Record what must come first
If the original trustee has died, we prepare the Affidavit of Successor Trustee first, and a certificate of trust if the exemption needs one.
We prepare the trustee’s deed
The deed from the trustee to the beneficiaries or buyer is drafted with the exact legal description, parcel number and Declaration of Value, and sent to you before signing.
The trustee signs by video
We schedule a remote online notarization with our partner Nevada notary at $25 per signature. The original comes straight back to us — you send nothing. South Las Vegas residents can sign in person at our partner’s office.
Same-day submission to the county
We e-record the deed the same day it is signed; the county typically completes recording the same day to 3 business days, and the recorded copy comes back to you.
